We pride ourselves on transparency and simplicity. Our privacy, terms, and agreements are no exception. Below we have drafted several policies and terms that may be revised at our discretion, at any time and without notice. By accessing our materials, communicating with us, or continued use of our services, you are agreeing to be bound by the then current version of privacy and terms of service.

Who We Are

Ava or https://ava.app, Flow with Ava or https://flowwithava.com, Leap R&D or https://leaprnd.com, are each a trade-name and property of Leap R&D Corp., or here-on referred to as “we”.

We are a research and development corporation organized and existing under the laws of British Columbia, Canada. You can learn more about our organization at https://leaprnd.com.

Your Use

If you do not agree with any of our policies or terms, you are prohibited from accessing any of our materials or use of any of our services.

Our materials are protected by applicable copyright and trademark law. When you visit our materials or communicate with us, we are giving you permission to read our materials. This is the grant of a license, not a transfer of title. Under this license, you may not: modify or copy our materials; use our materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any of our technologies; remove any copyright or other proprietary notations from or materials; or transfer our materials to another person or "mirror" the materials on any other server.

This license will automatically terminate if you violate any of our restrictions or further terms below, and may be terminated by Leap R&D Corp. at any time as a consequence. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Your Data

Your privacy is important to us. It is Leap R&D Corp.’s policy to respect your privacy regarding any information we may collect from you across our websites and listed social-media accounts we own and operate.

We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. We also let you know why we’re collecting it and how it will be used.

We only retain the collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.

We don’t share any personally identifying information publicly or with third-parties, except when required to by law.

Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies.

If you are an active user of our technologies and services such as Ava, we go through great lengths to protect you and your sensitive data beyond the industry standards.

Any data that you may generate with our application will exclusively belong to you unless you permit us otherwise. We do not aggregate any data outside of your organization’s Ava infrastructure except notifications of software errors for support. Your Ava will not be accessed by us except during on-boarding or support. Any access to your Ava by our team is audited and tracked for your security.

Some of your organization’s data will be shared with third-party vendors (e.g. the cloud hosting platform, the email provider, the telephony provider, etc). Each of these vendors has their own independent privacy policy and terms of services.

You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of your desired services. Your continued use of our website or communication with us will be regarded as an acceptance of our terms and practices around privacy and personal information.

Our Warranty

We take the credibility of our materials (including communication) and services (including the performance of our technologies), extremely seriously. Our materials and services are provided on an ‘as is’ basis. While we work hard to continuously improve training and update any information made available along with maintenance, development, support, and monitoring of our services including infrastructure, security, and technologies, we can not guarantee the accuracy, completeness, or how current such data or graphics are; similarly, nor can we or our partners be held responsible for any damages arising from the use of our services and technologies, including any loss of data or profits from any interruption to your organization and it’s business.

We reserve the unconditional right to not support or maintain the service of any organization at our sole discretion, with or without any notice. We may choose to suspend or terminate your service based on abuse, suspicions of illicit activities, improper practices or standards, or your support of cause and products that are deemed harmful to the general health of the public. Please respect your local laws and ensure your regulatory compliance wherever you may operate. Respect the privacy and data of those you serve with clarity and with international best practices and standards. Refrain from abusing any of our solutions beyond what they’re advertised to support.

We are prohibited to provide any service to any organization operating in Cuba, Iran, North Korea, Sudan, Syria, and the Crimea region or particular entities listed on any U.S. Government Denied Party/Person List, (eg. OFAC). If we’re made aware of any violation we will block and terminate any service provided to you without notice.

We’ve not reviewed all of the sites linked to us and we are not responsible for the contents of any such linked sites. Similarly, the inclusion of any links in our materials does not imply endorsement by Leap R&D Corp. of the site. The use of any third-party links is at your own risk.

Our Charges, Cancellations and Returns

When subscribing to a service with us, you authorize us to invoice or apply the agreed charges to the pre-authorized payment method provided. These fees shall always be applied unless otherwise stated by a promotional offer. Leap R&D retains the right to cancel or suspend any future promotional offer without prior notice.

We try and absorb all transaction fees where possible, but your bank may charge additional fees directly to you. If your banking is outside of the United States of America, currency conversion is the most common fee you may see on your statements; remember, we always charge in United States’ Dollars (even though we are a Canadian corporation, most of the expenses required to provide our services are pegged to the USD currency). If you have any additional questions about this possible currency conversion fee, please contact your bank or issuing credit-card provider directly.

Most fees due or charged are non-refundable as they represent expenses we’ve already endured to provide you with the subscribed service. When an account is canceled, you will not incur any additional charges going forward.
